These Terms and Conditions ("Terms") govern the use of the mineralsouq.com ("Platform") operated by AMSH Technologies (Private) Limited ("Company"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to all of these Terms, do not access or use the Platform.

• Acceptance of Terms: By accessing or using the Platform, you agree to these Terms, as may be updated by the Company from time to time. You should check this page regularly to take notice of any changes made

• Platform Use: The Platform provides a marketplace for the advertisement of equipment’s and services, sharing discoveries and sale / purchase of mines and minerals and related products and services. Users may list equipment’s, services, discoveries, mines, mining right and minerals for information, sale, or browse listings to purchase the prior mentioned items.

• User Accounts:In order to access certain features of the Platform, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

• Listing and Purchasing: Users may list equipment’s, services mines, mining rights, discoveries and minerals for information, or sale on the Platform, including descriptions, pricing, and any other relevant information. Buyers may purchase these items listed on the Platform. The Company does not verify the accuracy or legality of listings, and users are solely responsible for the accuracy and legality of their listings.

• Fees:The Company may charge fees for certain features or transactions on the Platform. Any fees will be clearly disclosed to users prior using the and feature and to completing a transaction.

• Intellectual Property:**: The Platform and its original content, features, and functionality are owned by the Company and are protected by copyright, trademark and patent under intellectual property / proprietary rights laws.

• User Content:Users may submit content, including listings, comments, endorsements, and messages, to the Platform. By submitting content, you grant the Company a non-exclusive, worldwide, royalty-free, irrevocable, sublicensable, perpetual license to use, display, distribute, modify, and reproduce such content on the Platform.

• Prohibited Conduct:You agree not to use the Platform for any unlawful purpose or to engage in any conduct that violates these Terms. Prohibited conduct includes, but is not limited to, the following:

  • - Violating any applicable laws or regulations;

  • - Engaging in hate speech, discrimination, or harassment based on race, ethnicity, religion, gender, sexual orientation, disability, or any other characteristic;

  • - Posting or promoting content that incites violence or promotes terrorism;

  • - Uploading or sharing materials depicting or promoting child abuse, exploitation, or any other form of harm to minors;

  • - Engaging in adultery or promoting extramarital affairs;

  • - Distributing or accessing pornography or sexually explicit material;

  • - Infringing upon the rights of others, including intellectual property rights such as copyright infringement;

  • - Harassing, abusing, or threatening other users;

  • - Impersonating any person or entity;

  • - Interfering with or disrupting the operation of the Platform or its users' activities;

  • - Posting or transmitting unauthorized commercial communications (such as spam);

  • - Collecting or storing personal data about other users without their consent.

• Government Requests:Under the law of the region/land, upon a request of the government, the Company may be required to share data with relevant government agencies in case of inquiries, investigations, or other lawful purposes.

• Disclaimer of Warranties:The Platform is provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. The Company disclaims all warranties, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

• Limitation of Liability:In no event shall the Company be liable for any indirect, incidental, special, consequential, or punitive damages, including, but not limited to, loss of profits, data, use, or other intangible losses, arising out of or relating to your use or inability to use the Platform. Company takes reasonable measures to safeguard your personal information, it's important to acknowledge that no method of transmission over the Internet or electronic storage is entirely secure. Therefore, Company cannot guarantee absolute security against hacking or unauthorized access. In the event of a security breach, Company will promptly investigate and notify affected users as required by law. However, Company shall not be liable for any damages resulting from such incidents.

• Indemnification:You agree to indemnify and hold harmless the Company, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your use of the Platform.

• Governing Law:These Terms shall be governed by and construed in accordance with the laws of Pakistan, without regard to its conflict of law provisions.

• Dispute Resolution:Any dispute arising out of or relating to these Terms or the use of the Platform shall be resolved exclusively through arbitration in accordance with the rules of the arbitration of Pakistan.

• Severability:If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.

• Entire Agreement:These Terms constitute the entire agreement between you and the Company regarding the use of the Platform and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and the Company.

By using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Platform.
